1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Plentiful website (getplentiful.com) and application (together, the "Services"). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.

2. Basic Terms

You are responsible for your use of the Services and for maintaining the confidentiality of your account credentials. You must not share your login details with any other person.

You may use the Services only if you can form a binding contract with Plentiful and are not a person barred from receiving services under the laws of the United Kingdom or other applicable jurisdiction. If you are accepting these Terms and using the Services on behalf of a company, organisation, government, or other legal entity, you represent and warrant that you are authorised to do so. You may use the Services only in compliance with these Terms and all applicable local, national, and international laws, rules and regulations.

3. Privacy

Any information that you provide to Plentiful is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United Kingdom and/or other countries for storage, processing and use by Plentiful.

4. Your Data

Plentiful is a personal financial management tool. The financial data retrieved from your bank accounts through Open Banking is used solely to provide the Services to you. Your financial data is private and is not shared with other users or made publicly accessible.

We do not claim ownership of your personal or financial data. We access and store your data only to the extent necessary to provide and improve the Services. You may request deletion of your data at any time by contacting us or deleting your account.

To maintain service reliability, we collect anonymised technical error data (such as stack traces, request URLs, and browser type) using Sentry. This data does not contain any personally identifiable information or financial data and is used solely for diagnosing and resolving technical issues.

5. Open Banking

Plentiful uses Open Banking services provided by an authorised open banking provider to securely access your bank account and transaction data with your explicit consent. By connecting your bank account, you authorise Plentiful and our open banking provider to retrieve this data on your behalf. You can revoke this access at any time by disconnecting your bank account within the Services or by contacting your bank directly.

Plentiful does not store your bank login credentials. All bank authentication is handled directly by your bank through the Open Banking framework.

6. Plentiful Rights

All right, title, and interest in and to the Services (excluding data provided by users) are and will remain the exclusive property of Plentiful and its licensors. The Services are protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Nothing in the Terms gives you a right to use the Plentiful name or any of the Plentiful trademarks, logos, domain names, and other distinctive brand features.

7. Restrictions on Use of the Services

We reserve the right at all times (but will not have an obligation) to suspend or terminate accounts, and to restrict access to the Services without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Plentiful, its users and the public.

8. Ending These Terms

The Terms will continue to apply until terminated by either you or Plentiful as follows.

You may end your legal agreement with Plentiful at any time for any reason by deleting your account and discontinuing your use of the Services.

We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe: (i) you have violated these Terms, (ii) you create risk or possible legal exposure for us; or (iii) our provision of the Services to you is no longer commercially viable.

9. Financial Information Disclaimer

Plentiful provides tools to help you track and manage your personal finances. The information displayed within the Services, including spending summaries, budget calculations, and account balances, is provided for informational purposes only and does not constitute financial advice.

You should not rely solely on the Services when making financial decisions. We recommend consulting a qualified financial adviser for personalised guidance. Plentiful is not responsible for any financial decisions you make based on the information provided by the Services.

10. Disclaimer of Warranties

Your access to and use of the Services are at your own risk. You understand and agree that the Services are provided to you on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted under applicable law, PLENTIFUL DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Some jurisdictions do not allow the disclaimer of implied warranties, and as a result the contents of this section may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLENTIFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORISED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

12. General Terms

Waiver and Severability. The failure of Plentiful to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

Governing Law and Jurisdiction. These Terms and any action related thereto will be governed by the laws of England and Wales. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in the courts of England and Wales, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

Entire Agreement. These Terms and our Privacy Policy are the entire and exclusive agreement between Plentiful and you regarding the Services (excluding any services for which you have a separate agreement with Plentiful that is explicitly in addition or in place of these Terms), and these Terms supersede and replace any prior agreements between Plentiful and you regarding the Services.
